Neither parent has an inherent right to custodyit is determined by the court based on the child's best interest, with joint custody often being the assumption. Judges consider factors like the child's needs, domestic violence, and each parent's ability to provide care when making a decision. Historically, mothers were often favored, but this is no longer the case in modern courts that focus on the best interests of the child.
The court's role
  • Best interest of the child:
A judge's primary consideration is what is best for the child, not which parent is a mother or a father.
  • Assumption of joint custody:
Courts assume joint custody is in the child's best interest, meaning both parents share in decision-making.
  • Sole custody:
A judge can award sole custody if they believe it is not in the child's best interest for both parents to have joint custody, or if there are issues like child abuse, neglect, domestic violence, or parental kidnapping
